1. Acceptance of terms
By creating an account on The Exchange, you agree to these Terms & Conditions and our Privacy Policy. If you don't agree, you shouldn't use the app.
2. Who can use The Exchange
You must be 18 or older and, where required for your trade, hold a valid licence to offer or accept work through the app.
3. The role of The Exchange
The Exchange is a platform that connects subcontractors and businesses in the construction industry. We are not a party to, and do not guarantee, review, or approve, any agreement, quote, job, or arrangement made between users. All terms of a job — scope, price, timing, and conduct — are agreed solely between the subcontractor and the business involved.
4. No handling of funds
The Exchange does not collect, hold, process, transfer, or guarantee any payment made between a subcontractor and a business for work performed. Any money owed for a job is arranged and paid directly between those users, outside of the app. The only payments we process are your own subscription charges for using The Exchange.
5. Disputes between users
The Exchange does not mediate, investigate, or resolve disputes between users, including disputes about payment, work quality, scope, or conduct. Users are solely responsible for resolving issues between themselves, including through independent dispute resolution or fair trading services where needed. 6. Limitation of liability
To the maximum extent permitted by law, The Exchange and its owners, employees, and agents are not liable for any loss, damage, dispute, non-payment, injury, property damage, or other claim arising from a job, agreement, or interaction between users, whether arising in contract, tort, or otherwise. The app is provided on an "as is" and "as available" basis, without warranties of any kind.
7. Indemnity
You agree to indemnify and hold harmless The Exchange from any claim, loss, or damage (including legal costs) arising from your use of the app, your dealings with other users, or your breach of these terms.
8. Verification information
We may display licence, insurance, or other credential information you provide, but we don't independently verify its accuracy in all cases and are not responsible for its accuracy or currency.
9. Account suspension
We may suspend or remove accounts that violate these terms, provide false information, or engage in abusive conduct toward other users.
10. Changes to these terms
We may update these terms from time to time. We'll let you know about significant changes before they take effect.
